✦ DISCLAIMER
1. At the time of commissioning me you agree to have read and understood the following terms and conditions, including changes or modifications made in the future.✦ CONTENT OF SERVICE
1. Commissions are all digital goods, unless otherwise previously agreed.
2. The Artist does not provide any service for NFT or AI purposes.✦ CLIENT OBLIGATION
1. The Client must specify the content of the Commission to the best of their ability. The Client is responsible for providing important information and a clear description / reference to the Artist prior to a commission agreement. Failing to provide information may result in the Artist’s inability to complete the Commission to the Client’s fullest satisfaction, in which the Client will be held responsible.2. The Client is obligated to respond to the Artist in a timely fashion. The Artist will not be held responsible for late delivery due to the Client’s negligence of communication. Absence of communication longer than five consecutive months will be considered as cancellation with no refund. Unless the client provides a valid reason and an agreement is reached to resume commission status.✦ DESCRIPTION
• The Commission display size has a default resolution defined in the description of each service. Custom display settings of the Commission is available upon request. A larger display size will incur additional illustration fees, to be defined and agreed upon in advance.• Commission pricing details can be viewed here on this site in the Commission section or through Vgen. All prices are as a guide only and may not represent the final price of a particular Commission.• A complex Commission will incur additional illustration fees, to be defined and agreed in advance.• Commissions for commercial purposes will incur additional fees, also to be defined and agreed in advance.✦ PRIORITIES OF OFFER
• If several commission proposals are submitted within the same time period, the Artist will prioritize each request accordingly. Commission offers that satisfy the following components are placed as higher priority than other offers. These components include the Artist's skill level, availability, flexibility of deadlines, and subject matter.• The Artist has the right to refuse any Commission request, without needing to explain the reason.• The Artist will refuse any depiction form of hateful, racist, violent or gory imagery.✦ PAYMENT
• Full payments must be made in advance to start your order.• Alternatively, a 50% up-front deposit can be paid to reserve a Commission slot or as a installment payment plan.• The payment method will be determined as previously agreed. The Artist’s preferred method of payment is via Airtm / DolarApp and VGen's built-in service (Stripe).
Additional payment methods can be made available to the Client upon request.• Currency: All prices are expressed in US Dollar (USD), and alternatively, ARG Pesos (ARS).• If payment is made in installments, the Commission and the ownership of it will only pass from the Artist to the Client until the agreed payment has been received. Any further work on the Commission will be suspended until an agreement is made and payment is received.✦ REVISION
• Revisions are categorized as major and minor revisions, in which each category has its limits and timing. It is up to the Artist’s discretion as to what constitutes minor and major revisions.• The timing and amount of revisions in which the Client is allowed to do will be defined and agreed upon in advance. Extra revision will incur additional fees, also to be defined and agreed upon in advance.• Revisions due to the Artist’s negligence are free of charge.✦ DEADLINES AND DELIVERY
• If the Commission is time-sensitive, a rush fee may apply, which will be defined and agreed in advance.• The Artist works on a regular turnaround of 30 to 90 days, unless otherwise agreed. If the order needs to be completed by a specific date, be sure to define and agree on it with the artist before the start of work.• The Artist can give an estimated time of how long the Commission will take to complete, and when the Client can expect to receive the finished illustration before the start of work. The Artist will inform the Client about progress (Including images) or if there are any disruptions to delivery times. The Artist is not obligated to explain the reasons for any extensions or delays in the completion of a Commission.• Illustration commissions are all digital goods, unless otherwise agreed. The completed work is delivered electronically via an online download platform in .png format, this does not include the original Commission files (eg. .psd, .clip, etc.), unless otherwise agreed or if the Client obtains written authorization from the Artist.• Delivery of complete work is submitted through email or an online download location (eg. GoogleDrive / OneDrive) for a finite period of time. The Client is obliged to download and store a copy of delivered work before the download location expires.✦ COPYRIGHT / INTELLECTUAL PROPERTY RIGHTS
1. Original works on this site and commissions authored by SandiaK are protected under the Copyright Act and may not be used without explicit written permission of the artist.2. The Artist retains all rights to the commission, which includes but is not limited to: Distribution, reproduction, use of the Commission for Artist promotion on social media, web sites and any other similar platforms.3. The Client may not use the commission beyond the personal use permissions, unless the Client obtains an exclusive commercial rights license with the Artist's explicit written permission.4. All payments made by the Client are for the creation of a personalized work by the Artist, and at no point in the agreement will the rights be transferred to the Client.4. Commercial rights license grant the Client special permission to use the commission for profit-purposes as defined and agreed upon in advance. This permission does not include the transfer of author rights to the Client.✦ REPRODUCTION
• The Artist reserves all reproduction rights, including the right to claim legal copyright, over all works.• Any sale, publication, or reproduction in any form without the Artist's prior express written consent is strictly prohibited. Publication also extends to social media (eg. Facebook, Instagram, Twitter) and any other similar platforms.• The Client may not distribute, reproduce, or derive any benefit from the Commission beyond what was agreed before the start of work.• The Client is granted permission to display the Commission on social media profiles and any other similar platforms, provided that the Artist's name ("SandiaKoo_") is prominently displayed. No tag needed, it's optional.• The Client may not edit, alter, or trace the Commission without the Artist's express written consent, beyond what was agreed before the start of work.• Distributing any Commission from the Artist to the NFT / AI community is strictly prohibited.✦ CANCELLATION
• The Artist reserves the right to stop working on a Commission, or cancel a Commission request due to poor communication, rude/inappropriate behavior, an inability to effectively communicate in English or Spanish, or a breach of these Terms of Service.• The Artist also reserves the right to stop or cancel work in the event of an emergency, accident, or illness.• The Client can cancel the Commission at any time. Refunds can be issued only if the Client cancels the Artist prior to start of work.✦ REFUND POLICY
• Full refund can be issued if the Client cancels the Artist before to start of work.• Refunds are not allowed once work has started, or if any of these Terms of Service are breached during any period of the commission.• Disliking the Commission or change of mind are not considered for a refund, this is minimized by providing drafts and images of progress throughout the Commission process.• Full refund will be issued in the event that the Artist must cancel work due to sudden unavailability or emergency.✦ DISPUTE
• In the event of a dispute, the Artist reserves the right to export time-stamped records of communication (e.g., screenshots) between the Client. These records will never be shared in a way that exposes the Client, but may be disclosed to third parties involved in resolving the dispute.ㅤ_{✦ Remember that any concerns you can talk to me.
